1. Introduction
These Terms and Conditions ("Terms") govern your use of the marketing services provided by SW Game Testing Sp. z o.o. ("Company," "we," "us," or "our"). By accessing our website or engaging our services, you agree to be bound by these Terms.
2. Services Provided
SW Game Testing Sp. z o.o. is a performance marketing company offering services including:

All services are custom-tailored to each client’s needs and defined in individual agreements or proposals.
3. Client Responsibilities
Clients agree to:
Provide timely access to assets, systems, or tools necessary for our servicesShare accurate information related to their business, audience, and goalsReview and approve deliverables promptlyPay all agreed-upon fees on time
4. Confidentiality
Both parties agree to maintain strict confidentiality about proprietary information, strategies, audience data, and business practices exchanged during the engagement. This obligation continues beyond the termination of services.
5. Intellectual Property
All intellectual property created by SW Game Testing Sp. z o.o. remains our property until full payment is received. After payment, ownership of custom deliverables (e.g., copy, creatives, funnel builds) is transferred to the client, unless otherwise agreed.
Pre-existing materials and tools used by either party remain their respective property.
6. Payment Terms

7. Performance Disclaimer
We aim to provide the best possible outcomes, but due to the nature of marketing and advertising, specific results (e.g., number of appointments, revenue, engagement) cannot be guaranteed.
8. Limitation of Liability
We are not liable for any indirect or consequential loss. Our total liability for any claim related to our services will not exceed the total amount paid by the client for the services rendered during the 30 days prior to the claim.
9. Termination
Both parties may terminate the agreement with 14 days' written notice. All outstanding work and payments must be settled upon termination. Breach of agreement or failure to cooperate may result in immediate termination.
10. Governing Law
These Terms are governed by the laws of Poland. Any disputes will be handled by the competent courts in Katowice.
11. Changes to These Terms
We reserve the right to update these Terms at any time. Updates will be posted at
